In 2011, the Arizona Legislature DID NOT PASS SB 1538, a bill that makes it a traffic violation with possible fines and penalties if a person is texting while driving. Learn more about SB 1538 SB 1538 , by going to the Arizona legislature's website.

CHANGE. This should not become a law. Trust me, I hate people who text and drive. But look at it this way, it is so hard to enforce something like this. Most people have there phone below the steering wheel.

KEEP. Texting while driving is a bad idea because their eyes should be on the road, not on their phones. This law should be not only be kept but strongly enforced.

KEEP. Although I can safely text while I drive, most people cannot. I deal with enough bad drivers on the road, maybe if they stopped texting it might be better. Of course, I wouldn't follow the law.

KEEP. Its terrible how people think its ok to text while they drive. It only takes 1 seond to cause an accident on the road. If yiou were texting on a dangerous road you could swerve and hit someone else.

Executive Action

The legislative branch voted that this law should be changed to read:

A person may not use a handheld communication device to write, send, or read a message while operating a motor vehicle.

Judicial Action

A case has not yet been filed with the court. The court cannot rule on the constitutionality of a law until it is brought before the court.
